Regulations

  1. GENERAL STATEMENTS
    1. The following rulings form a regulation pursuant to article 4 of Transport Law Act, which defines the conditions for Passenger service as well as people and item transportation.
    2. The following terms used in the regulation shall mean as follows:
      1. Carrier – the company responsible for transport of people (Passengers);
      2. Passenger – a person using the transportation service with a valid ticket;
      3. Luggage – items travelling with Passengers on board or in the luggage compartment.
  1. CARRIER
    1. The Carrier is obliged to:
      1. perform the transportation of the Passenger and his luggage to a selected destination;
      2. provide the Passengers with appropriate safety and hygiene conditions, as well as comfort and proper service;
      3. provide the Passenger with a replacement vehicle in the case when the journey has been interrupted as a result of the car’s failure and is impossible to be commenced otherwise.
    2. The Carrier shall make every effort to transport the Passenger and his luggage in appropriate time, if such was stated. The times of departure and arrival are determined during the booking process.
    3. The Carrier shall not be hold responsible for delays or cancellations resulting from factors independent of the Carrier (such as weather and/or road conditions) nor for further consequences of such occurrences.
    4. If necessary, the Carrier may change the subcontractor of the transportation service or the vehicle.
    5. The Carrier shall be entitled to refuse the Passenger to take a seat in the vehicle or continue his journey without the necessity of reimbursement of any travel costs borne by the Passenger, if the Passenger:
      1. does not comply to the terms of transportation agreement;
      2. is or shows signs of being under the influence of alcohol or intoxicants (e.g. drugs);
      3. is or shows signs of being ill and as a result may pose a threat to other Passengers’ health;
      4. behaves in a manner that affects other Passengers’ travel comfort;
    6. The Carrier shall not be held responsible in the case when the Passenger provides an invalid or incorrect address.
  1. PASSENGER
    1. The Passenger is obliged to:
      1. await (a vehicle) at the place (address) and the time agreed with the Carrier;
      2. follow the instructions of the vehicle driver;
      3. provide the Carrier with a detailed address (post code, city/town, street name, building number);
    2. Children below the age of 12 must travel with an adult. Children between the age of 12 and 16 may travel on their own, but must present a legal consent to travel independently signed by both parents or legal guardians.
    3. If the Passenger is not present at the indicated address on the departure day within the specified time period, it is treated as the Passenger’s resignation from travelling.
    4. The vehicle driver’s waiting time at the indicated address is 5 minutes.
    5. The Passenger is obliged to keep the seatbelts fastened while travelling.
    6. Smoking and alcoholic beverages consumption in the vehicle is prohibited.
    7. The Passenger is provided with Accident Insurance by the Carrier. The insurance covers only those situations that may occur while the Passenger is in the vehicle. Any incidents resulting in damages to the Passenger while not in the vehicle are not covered by the insurance.
    8. The Passenger shall be held responsible for all the damage done to the Carrier and to other Passengers.
  1. LUGGAGE
    1. The Passenger is allowed to take 2 luggage items free of charge:
      1. one luggage item transported in a luggage compartment of weight defined by general airline regulations;
      2. one hand luggage item weighing no more than 10 kg.
    2. The Passenger is allowed to travel with a second luggage item travelling in a luggage compartment after submitting a fee, however, the total weight of both luggage items may not exceed 35 kg.
    3. The Carrier has a right to refuse taking the luggage on board if it does not fulfil the requirements stated in this regulation.
    4. It is forbidden to transport luggage and possess materials and items that could endanger the safety of the journey, injure other Passengers and the Carrier and/or result in other Passengers’ discomfort.
    5. The vehicle driver decides upon the transportation of each additional luggage item in all situations.
    6. Each luggage item transported in a luggage compartment should be labelled by a Passenger.
    7. It is forbidden to transport items the transportation of which is forbidden on the basis of separate regulations.
    8. A luggage item may be controlled by the Carrier if there is a justified suspicion that the luggage item is breaching the above mentioned conditions (in accordance with article 23 point 3 of the Transport Law).
    9. A luggage item that may not be attributed to any Passenger on board can be removed from the vehicle by the driver.
  1. COMPLAINTS
    1. All complaints concerning the execution of the transportation agreement should be filed in person, through a registered letter sent to the postal address of the Carrier or by e-mail.
    2. Complaints can be filed within one month time after the incident which is the subject of the complaint took place. It is necessary to specify all the circumstances, reservations, (possible) damages and claims resulting from these. The Carrier shall consider the complaints within 30 days counting from the date of the complaint delivery.
    3. When considering personal and luggage damage the only person entitled to make a complaint and file a claim is the Passenger himself, or, in justified cases, his legal successor.
    4. The complaints concerning the luggage travelling in a luggage compartment can be filed only at the moment of receiving the luggage and to the person handing the luggage.
    5. All items left in the vehicle by the Passenger due to carelessness or other circumstances are not subject to protection or responsibility of the Carrier. When receiving information on items/luggage left by the Passenger in the vehicle, the Carrier shall make every effort to deliver such item/luggage to the Passenger. The expense of such a delivery shall be covered by the Passenger.
  1. FINAL PROVISIONS
    1. In matters not specified in the Regulation the following laws apply:
      1. the Act as of November 15, 1984 Transport Law (consolidated text Dz. U. [Journal of Laws] 2000, No. 50, Item 601 with subsequent amendments);
      2. the Act as of April 23, 1964 Civil Code (Dz. U. [Journal of Laws] 1964, No. 16, Item 93; with subsequent amendments).
